I Have Been Denied a US F1 Student Visa For The Second Time.Wednesday, July 23, 2008
So today I went to the US embassy for the second time for a Student F1 visa application interview and I have been refused a visa for entry into the United States. Last time I was denied it was laid on the bases that I did not provide any compelling evidence at the time of my interview to compel me to return home after completing my studies. I understood and they were completely right for doing so but this time around all the evidence was there, I was so convinced that finally I will be granted a Student visa to pursue a computer science education in the United States but once again the sweet consular woman said I am sorry to inform you that the law has not change and that I still find you to be ineligible for a US visa... Coming think of it, I think what it comes down to is that she doesn't like me for some reason. I mean what I have done to deserve that. Last time she only interviewed me for barely a minute and this time around I can swear it was less than 30 seconds.
All she asked me was that ... has anything changed in your application from the last time that you applied I replied yes and I pointed to her that there is a letter from my sponsor emphasizing my ties to the Gambia and original documents showing evidence that my family owns a home and land in the Gambia and also a brief talk in writing about my career goals upon returning to The Gambia. Then she asked me why do I want to go to the particular school and I said I have found out that it's a good school which lays strong emphasis on technology and it suits me financially... but oh no that was not enough to convince her. I was not even given the chance to defend my self and no suggestions where made to me on how to overcome the refusal just in-case I choose to reapply in the future. The most hurtful part of the whole thing just like in my first time is that, as it was clearly stated in their rejection letter that I cannot appeal their decision. Its like being convicted of a crime that you did not commit and the justice system won't allow you to make an appeal. Where is the sense of justice and equal rights for all that the United States is so outspoken for To me that is clearly missing here. I have nothing against the United States, in-fact I am a great admirer of its people for they are in the forefront of creating innovative ways, research and technologies that add to making our lives on earth more productive and interesting in many ways. Anyways, it all cones down to one thing, if you are from my race and my continent, you'd probably gotten used to the double standards everyone else applies to you. I am talking about poor Gambians here including my self who have lost $131 or more just like that without the chance to appeal the consulate's decision and not forgetting to mention a refund of at-least some of their money. They will tell you that, that the money goes in to the Visa processing but wait I filled in the form and I printed it from their website then I went to the bank, paid $131 in to their account and stood before the consular on my interview day and I was asked 1 question and then refused a visa without a chance of an appeal or refund and you tell me that is Visa processing. There has to be a stop to this reign of Visa Terror by the US Embassy because to me it certainly is if you, like me lost so much money and resources and not to mention precious thinking time you devote to the whole process. It's time someone takes the lead and put an end to this injustice. I am going to report this to the Human Rights Watch (HRW), the United States Embassy in The Gambia (they can just ignore it like my last email if they like) and I am going to find ways to report this to all major international new media providers like CNN and BBC including our local media, the US and Gambia governments. Also to publicize this on social media buzz websites I will. You know just a little something to create awareness of what's happening. Even if I will never benefit from a compensation or money refund once the whole thing is resolved, I know my fellow citizens certainly will. So, that is $262 the US government owes me for the two F1 student visa applications I've applied for. I know that they say the visa application fee is non refundable but I don't care because that is money I worked hard for and I want it BACK. Somehow they are just going to have to pay me back and I mean it. I will probably never apply for a US student visa again because it is a very humiliating experience when you get rejected and your chances of getting one after two earlier rejections is very slim. With that goes all me hopes and dreams and my chances of getting a computer science education of my choice all shattered in-front of my eyes. I have a compulsive urge to pursue education in the field of what love and i have to admit that it is extremely painful and difficult and it hurts getting denied of that. Right now I feel like just sitting here and cry out loud like a little child no kidding. I wont WHY Because I am a grown up and I believe when one door closes another one opens and who knows, everything happens for a reason and this one of those things part of my destiny. Perhaps this is what is best for me right now. I think that i have the whole thing figured out. I know exactly what I want and what I am capable of doing, going to school was one way of getting there. I have known that without going to school it will be a long and difficult road but I guess now it is time to take the trek head on. I suppose It's time to bust my head out of the my egg shell and start to life my life. I am a very defiant and an extremely rebellious person by nature but still very law abiding (more that normal) and peaceful (I suppose it all has do with my religion). They can't hold me down, now more than ever I am more determined than I have ever been my entire life. We are all meant for a purpose and I will certainly serve mine. God willing next time I apply for a US visa, it will be to attend a Microsoft developer conference or something and I will be the owner and CEO of Gambia largest software development firm. I think its time to realize the BarrowBros. dream but it's a long and difficult road and OH boy where do I start Anyway, till then, but right now I need to relax. I had a terrible ordeal today. Your story is very heart-felt and I hope you find the education you deserve. Start your own business in Gambia (or partner into one), work it for a year so its established then you will be accepted for a visa. That way you will have something real which they will believe you will come back to. Until then, they will just say, "Nothing's changed". Why don't you apply for a different visa so that you can live and work in the USA as well as apply for college? Why not apply with full intent to live in USA and eventually pursue citizenship there? With a Green Card you can then freely travel back and forth from Gambia to USA at your own expense and leisure. It may take a while but is well worth it, if you ever want to do business there too. I am from Nepal and today morning i had my second visa interview. last time i was denied, they told me 'You do qualify but i need more information on the university you are going to' and when i made an attempt to explain, she just looked away. I thought okay, may be i fell short on my research and re-applied and made full research on the university site. today i had my second interview and the consular tells me 'You donot have enough funds' even tho i did have 60% scholarship awarded to me and my yearly expense was arnd $14K and i did have $177K amount mentioned in my CA report... also i am a very good student with distinction and have been performing very well in my current job. they are a bunch of blood sucking people. disrespectful people.. when i had the academic backgrnd and ties to come back to my country, the company i am working for had given me a letter stating they want me back too... !!! i wish those people rot in hell. i cant even go and study which i genuinely had wanted to and spent so much money, time and energy.. Eastern Europeans aren't welcomed much more than Africans?believe me. I had a chance to witness this first hand while my parents struggled to make a life for us in Canada. In the end though, they were successful and I will be forever grateful for the effort, work, and sacrifices they made. I would recommend applying for school in Canada. We have many great, great schools. Vancouver (where I'm from) is an epicenter for web stuff?it's the kid brother of San Francisco. I did a year at VFS in the interactive design program. We had many foreign exchange students from all over the world. There were people from Pakistan, Trinidad, Korea, China, Japan etc. As for the US and freedom and acceptance...forget about it. The US is a joke in it's current state. They treat people like frakin' criminals at the borders, no matter where you're from! As a country they are a bunch of ignorant, disrespectful assholes?sadly there are also a bunch of great Americans who are ashamed of what the States has become. Going to the consulate for an interview makes me feel humiliated. U.S. is making enemies at the consulates and at the borders. They should realize that. I was rejected 6 times, two times by interview and 4 times by mail. It got the visa 5th time by mail. They never looked at my application, and kept rejecting me everytime. I kept mailing them back the same application after every reject and they finally granted me the VISA. As someone else has already mentioned you could study in the UK, as they have excellent universities there. Or you could just come down here to South Africa, we also have some excellent universities. Another option would be online courses, as you can get any information you want, especially on technology, from the internet. Forget about the US and try the UK , even if you are denied uk students visa you can appeal the decision.And their is also canada you have alot of options stil mate , good luck . That's frustrating. Unlike many other countries, the United States does not impose internal controls on most visitors, such as registration with local authorities. In order to enjoy the privilege of unencumbered travel in the United States, aliens have a responsibility to prove they are going to return abroad before a visitor or student visa is issued. Our immigration law requires consular officers to view every visa applicant as an intending immigrant until the applicant proves otherwise. In making a determination the officer considers the applicant's personal circumstances, travel plans, financial resources and ties outside of the United States that will ensure his/her departure after a temporary visit. WHAT IS SECTION 214(b)? Section 214(b) is part of the Immigration and Nationality Act (INA). It states: Every alien shall be presumed to be an immigrant until he establishes to the satisfaction of the consular officer, at the time of application for admission, that he is entitled to a nonimmigrant status... To qualify for a visitor or student visa, an applicant must meet the requirements of sections 101(a)(15)(B) or (F) of the INA respectively. Failure to do so will result in a refusal of a visa under INA 214(b). The most frequent basis for such a refusal concerns the requirement that the prospective visitor or student possess a residence abroad he/she has no intention of abandoning. Applicants prove the existence of such residence by demonstrating that they have ties abroad that would compel them to leave the U.S. at the end of the temporary stay. The law places this burden of proof on the applicant. Our consular officers have a difficult job. They must decide in a very short time if someone is qualified to receive a temporary visa. Most cases are decided after a brief interview and review of whatever evidence of ties an applicant presents. WHAT CONSTITUTES "STRONG TIES"? Strong ties differ from country to country, city to city, individual to individual. Some examples of ties can be a job, a house, a family, a bank account. "Ties" are the various aspects of your life that bind you to your country of residence: your possessions, employment, social and family relationships. Our consular officers are aware of the diversity of applicants, ethnic and social groups, and countries. During the visa interview they look at each application individually and consider professional, social, cultural and other factors. In cases of younger applicants who may not have had an opportunity to form many ties, consular officers may look at the applicants specific intentions, family situations, and long-range plans and prospects within his or her country of residence. Each case is examined individually and is accorded every consideration under the law. IS A DENIAL UNDER SECTION 214(B) PERMANENT? No. The consular officer will reconsider an applicant?s situation if an applicant can show further convincing evidence of ties outside the United States. Although there is no appeal process, applicants may file a new visa application at any time. Unfortunately, some applicants will not qualify for a nonimmigrant visa, regardless of how many times they reapply, until their personal, professional, and financial circumstances change considerably. Having your visa application refused here in The Gambia does not make you ineligible to receive a visa in the future. U.S. consular officers will understand that your application here was evaluated and refused based on the strength of your ties to The Gambia at the time of your application. If you choose to apply here or anywhere else in the future, your application will be evaluated based upon your ties at the time of your new application. Applicants should remember, however, that providing false or misleading information in a visa application can result in the permanent refusal of visa benefits. Consular officers can view past applications to ensure that the information provided by an applicant is true and correct. Applicants should be able to explain any changes to information provided on subsequent applications. CAN MY FRIEND OR RELATIVE PROVIDE A GUARANTEE? Friends or relatives in the United States or abroad may provide a letter of invitation or support. However, this cannot guarantee visa issuance to an applicant. Visa applicants must qualify for the visa according to their own circumstances, not on the basis of a sponsor's assurance. WHAT CAN YOU DO IF YOUR ARE REFUSED A VISA UNDER 214(B) FOR LACK OF A RESIDENCE ABROAD? First, the applicant can review carefully their situation and evaluate realistically their ties. They could write down on paper what qualifying ties they think they have which may not have been evaluated at the time of their interview with the consular officer. Also, if they have been refused, they should review what documents were submitted for the consul to consider. Applicants refused visas under section 214(b) may reapply for a visa. When they do, they will have to show further evidence of their ties or how their circumstances have changed since the time of the original application. It may help to answer the following questions before reapplying: (1) Did I explain my situation accurately? (2) Did the consular officer overlook something? (3) Is there any additional information I can present to establish my residence and strong ties abroad? Bear in mind that you will be charged a nonrefundable application fee each time you apply for a visa, regardless of whether a visa is issued. WHO CAN INFLUENCE THE CONSULAR OFFICER TO REVERSE A DECISION? Immigration law delegates the responsibility for issuance or refusal of visas to consular officers overseas. They have the final say on all visa cases. By regulation the U.S. Department of State has authority to review consular decisions, but this authority is limited to the interpretation of law, as contrasted to determinations of facts. The question at issue in such denials, whether an applicant possesses the required residence abroad, is a factual one. Therefore, it falls exclusively within the authority of consular officers at our Foreign Service posts to resolve. An applicant can influence the post to change a prior visa denial only through the presentation of new convincing evidence of strong ties. CAN I APPEAL OR SEND MORE DOCUMENTS? As your application has been refused under Section 214(b), there is no reconsideration or appeals process aside from filing a new application. U.S. law contains no provision for appeals. Although the Consular Section attempts to be responsive to inquirers, please understand that our policy is to not respond to correspondence from an applicant regarding a finding of ineligibility under Section 214(b). A written explanation of the reasons why you were unable to establish your eligibility for a visa will have been handed to you on the day of the visa interview. Once a case is closed the Consular Section cannot take any further action. If you feel that you omitted evidence material to the visa decision, the proper course of action is to reapply for a visa and appear at the Embassy in person. Applying for a non-immigrant visa is not primarily a document-based process. The main issue in determining if an applicant qualifies for a visa is intent, and documents alone cannot establish intentions. In some cases, documents can help establish an applicant's intent to return to The Gambia by showing that the applicant is well established here. In other cases, the circumstances are clear enough that documents are unnecessary. If your visa application has been refused it is highly unlikely that any single document you could provide would alter the consular officer's decision. I HAVE STRONG TIES IN ANOTHER COUNTRY, WHY WAS I REFUSED? U.S. immigration law requires consular officers to view applicants as intending immigrants until they prove otherwise. The burden of proof is on the applicant to show they have strong ties outside the United States. The consular officer who evaluated your application is accredited in The Gambia and is best able to assess your ties to The Gambia. It is not possible for consular officers here to be experts about all other countries, or to understand any social or economic ties you may have to another country. Nevertheless, even though your application has been refused in The Gambia, if you are here temporarily you may be able to qualify for a visa if you applied at home. Consular officers in your home country are better able to assess your situation there. I AM A LEGAL RESIDENT OF THE GAMBIA, WHY DON?T I QUALIFY FOR A VISA? Many refugees or recent immigrants to The Gambia cannot demonstrate sufficiently strong ties here to qualify for a non-immigrant visa to the United States. There is no magic formula that will work in each case. In general, you must be able to show that you have settled in The Gambia and that this is, and will remain, your permanent home. In reviewing your application, the consular officer considered many aspects such as: How long have you been at your current address? How long have you been at your current job? Are you, or are your children enrolled in school? What commitments do you have here that would compel you to return to The Gambia? What social ties do you have in The Gambia? Often it is a question of time, and the best way to qualify for a visa is to reside in The Gambia for a longer period of time and to build further social and economic ties here. WHY DIDN?T SOMEONE TELL ME I WOULD BE REFUSED? ISN?T THERE A CHECKLIST FOR WHAT I NEED TO GET A VISA? Each visa application is thoroughly examined and evaluated on its own merits. Since it is impossible to obtain all relevant facts without seeing your passport, completed application, and personal interview, we are unable to tell you prior to your interview whether you will or will not receive a visa. The information distributed on the Internet and through travel agents, is designed to give general information regarding the visa application process and suggest types of documents that might help demonstrate eligibility for a U.S. visa. However, there is no standard checklist for what will qualify for a visa and in no circumstances is someone able to guarantee in advance that you will receive a U.S. visa. WHY CAN?T I GET MY MONEY BACK? The fee that you paid is an application fee. Everyone who applies for a U.S. visa anywhere in the world must pay this fee, which covers the cost of adjudicating your application. As the application form states, this fee is non-refundable regardless of whether you are issued a visa or not. If your application was refused under Section 214(b) and you choose to reapply for a visa, whether at this Embassy or elsewhere, you will be required to pay the application fee again. WHY HAVE YOU STAMPED THE BACK OF MY PASSPORT? The stamp in your passport, along with our worldwide computer system, simply indicates that your visa application was processed here in Banjul. This stamp enables us to match subsequent applications with a file. WILL MY REFUSAL PREVENT ME FROM GETTING A VISA IN THE FUTURE? Having your visa application refused here in The Gambia does not make you ineligible to receive a visa in the future. U.S. consular officers will understand that your application here was evaluated and refused based on the strength of your ties to The Gambia at the time of your application. If you choose to apply here or anywhere else in the future, your application will be evaluated based upon your ties at the time of your new application. I HAVE BEEN TOLD THAT MY REFUSAL IS PERMANENT. WHAT DOES THAT MEAN? In some cases, applicants are found to be ineligible for a visa under other sections of law. These are not 214(b) refusals. The most common ?permanent? refusals are for fraud, misrepresentation, and alien smuggling. If a consular officer determines that you provided false or misleading information during a visa application, such as changing your identity or concealing pertinent information requested on the application, or if you assist another person in an attempt to obtain a visa through fraudulent means, you may be permanently refused. If you have received a permanent refusal, you are ineligible to receive a visa at any time in the future. Some other refusals carry limits on their duration. For instance, if you remained in the United States beyond your authorized length of stay, you could receive an ineligibility from 3 to 10 years from the time you departed the United States. I told her I found fee structure relatively cheap which was almost 15000 including living and tution. Again she started to shout at me. What will you do when you return back. ( how will i know i was yet to receive it!!! ).. did u inform the college about this scholarship???.. bla bla..bla...I thought as if it is going to took forever and to top it all he asked me to hold on and vainished for good 4 minutes with that email print..god knows where,...then he reappeared with a sudden seriouness in his face....then right away he started to write something in his computer.. I asked what are you writing sir ya i did..haha..well i dont know why i did maybe because i dont wanna hear u not qualified mam again..AND HE said.. next time bring only the passport I20 and the formal confirmation of your scholarship leave it to the reception desk between any working hours and i will contact you..what kinda rejection was that..!!!CAN SOMEDODY ELABORATE..he handed me semi denail paper under act 221(g).. which mention the submission of the formal letter...

You must had the original copy of offer letter and I-20 to apply. They never believe an email because u know, in these days it's very easy to create such emails using different tools. You know, I have similar type of case. I have already applied 2 times for F1 Visa. Both time, they said me my family cant afford my study. At this time, I have got 62% assistantship from the same university that I had applied on June 16,2009. I waited for 1 week. I paid the FeDex cost by myself and asked university to send offer letter and new I-20. After that only I took date. So, don't worry.You will get visa, if u reapply with original I-20 and offer letter. What you can now do is to ask your university to send your offer letter thrugh FeDEX. It takes only max of 4 days to arrive Nepal through Fedex. When asked why I wanted to go i answered "to study my faith in depth and that I felt led by God" i was told that this was not a concrete reason and it wasn't good enough! I have satisfied the Bible School why I want to do this course and supplied references if this officer is not a christian would he even know what a concrete answer would be. Also I had lots of documents to show as proof as to why i would return but these were not even looked at. I have the money to do the course but was told this was very convenient! In 2009 I came to Ghana and a friend introduced me to someone who could be of help. The man arranged a Ghanaian passport for me and got me a protocol visa to the United States. I have the same experience in my life. In my childhood I listened many things about Japan, Japan is excellent country, advance country, Japanese people are very good friendly. So I started to study Japanese after I gave the Intermediate level exmination in Management. When I passed the Intermediate level exam I joined BBS in Tribhuvan University, the University which is very world but does not provide quality of education. I always wanted to study abroad after completing my Intermediate level exam. But I didnot have suffice funds to go abroad, I tried to go to Japan when I was studying in BBS first Year I was victims of cheating from Nepalese. Later on, I studied some more Japanese and got admission in one of the Japanese Language School in Japan for short term course for Learing Japanese. I applied for Visitor visa of Japan for 3 months and went for the interview. The counsellor asked me some questions in Japanese and granted me a Visitor visa of Japan. I was so happy when I got the visa stamp in my passport. I went to Japan for 3 months period and stayed there came back to my home country. Later on I tried for Student visa getting admission in Japanese Language school for full time student. I got Student visa of Japan. After completing my Japanese Language course I started to study in 2 Years Vocational college in Computer Information System in Japan. When I was a First Year student in that College at that time one of my Japanese friends told me that he was going to USA for one week visit, In the same time I also made my mind up to visit there for one week with him and his family members because he and his family members were not so good in English. I knew some English to communicate with American people. They were also agreed to go with me. I still remember all those things that I prepared to apply for USA visitor visa. I prepared application my self, I paid visa fees and went to interview in US Embassy in Tokyo. The counsellor called me and asked me that where is your Japanese friend ?I answered that they are in Japan? Again He asked me that what inspired you to visit USA? I did not hear this question clearly and I said sorry? The counsellor excited and asked the same question loudly? I just answered him that I would like to visit USA in my vacation with my Japanese friend. So he just started open pages of my passport and stamped in my passport third last page that I am sorry that I cannot provide you visa in this time because the passport from which you are applying visa isnot eligble for US visitor visa and the condition of Nepal is good in this time. And he mentioned me that in the future if you make good ties to return in Japan that time I can recommend you for Visitor visa to USA. And lastly he asked me that What are you studying here? I got high tention and just answered " Computer!". He gave me my passport back. The counsellor really don't know whom they have to provide visa and whom not. I did not have any intention to overstay there in USA. As I know that they have recommened tourist visa to many Nepalese Actors and Actress and Singers from Nepal and Many of them overstayed there and applied for permanent residence and few of them got back. I am not like them but even though Visa officer couldnot recognized me. They are full of stress and unable to find who is honest and who is not. I applied tourist visa for thailand, Korea and Schegen country I got easily without interview and with interview because I am working here as an Engineer. Last time I felt that I should make my English better for my better career opportunity here in Japan because if I have good command in English I can make my earning twice then my current Earning per year. My current per annum is 40 thousand US dollor. So I thought to study one year english course in canada because canada is great country for study and experience new life. I got an admission in one of the canada's Language Institute and applied for student permit for one year coz if I stayed there more that one year my current Engineer visa will be collapsed and I will not able to continue my visa moreover. Immigration of Japan is also not so easy for foreigners. I prepared all the documents and fulfilled my application form and paid visa fees and applied for student permit. I showed my company's papers in Japan, Bank balance about 30 thousand canadian dollors. My current Income tax papers and my own company papers. to the canadian Embassy of Tokyo. But sent me visa refusal letter stating that <<< 1. You have not satisfied me that you will leave canada by the period authorized for your stay. 2. You have not satisfied me that you are a bona-fide temporary resident only seeking temporary entry to canada for study, nor have you satisfied me that you have a reasonable and credible motive for studying in canada. >>> without inteview and without medical. Just within two days they decided about my plan for the future that I am going to stay forever in Canada. The visa officer really do not how to grant visa! They always make mistake and wrong person gets visa and enters in their country and get permanent after illegal stay. So I want all you people to know that God is looking all these things and determing when to give you chance and where to send you. once upon a time I was rejected student visa for singapore too. Now in Japan nor I have visa problem nor money. Next Year I am going to apply for Japanese passport, I hope I will get it. Pray for me. And visit all the country without visa, even USA or Canada. On the other hand we students have to prove that we would return back to our native countries after completing our studies- which 99.99% of us never do. I thought the same- but after 15 years i am still in Australia. We try to kid ourselves that we will go back to our countries after finishing studies. The officers look at the statistics- 99.99%. Some of us (ALIENS) finally make to the GooD countries. and live there forever and spoil the chances for newcomers like you. Had we returned back it would be lot easier for you. Sorry about that. It's a painful and bitter story which a lot of people are similarly experiencing but I'm glad about your determination not to let your dreams be shattered by this setback. A lot of Nigerians are denied visas similarly (I've had friends wha have and who have lost money, time and energy as well) and I just realised through your post that other Africans pass through this ordeal too. I hope you have made a lot of progress since then towards your goals of achieving great things. I'm particularly touched by the fact that you'll stop at nothing to get to where you are meant to go and I share these believes as well.

It has very good study atmosphere especially the faculty that is highly qualified. Most importantly It has very good student to faculty ratio ie. 10:1 that is highly favorable for students studies. VO: Which other universities have you applied to? Me: I have applied to Purdue, USC .( I was telling about other 2 universities also, but he interrupted) VO: Why not Purdue? Me: Coz Ive got a rejection from there. VO: And what about USC? Me: Ive got rejected there too. Also, Ive applied to 2 other universities whose decisions are still awaited they are SUNY Buffallo and Texas A&M. VO: What are your qualifications? Me: Ive done Civil Engineering from Jamia Millia Islamia University.(I wish I didnt tell him the name of the university, after this he started asking negative questions..) Me: They just provide us with these grades and there is a CPI at the end. If their judgments are wrong,the applicants has no right to appeal and it is traumatic because they are recorded forever with visa rejection after losing the Visa fees. The money which international students spend contributing and helping U.S. Economy each year, generating more jobs,more state, and local taxes. And, this money has a multiplying effect in the economy of U.S, I cannot understand why they reject so many students Visa.

However, this is a bad regulation of U.S. Immigration because anyway you have to come back to home country after you finished the study because you cannot stay illegally anymore there. And, enough money bearing all financial responsabilities during studying. I suggest, to consultan U.S. immigration attorney.
